Terms of Service

These Terms of Service (the “Terms”) apply to everyone who visits or uses PornNook (the “website”, “we”, “us”), whether you have an account or not. By using the website you agree to these Terms. If you don’t agree, don’t use the website.

We may change these Terms at any time. The date at the top shows when they last changed. If you keep using the website after a change, you accept the new Terms; if you don’t accept them, stop using the website.

The website contains sexually explicit material and is for adults only. You may use it only if you are at least 18 years old, and at least the age of majority where you live and where you access it from if that is higher, and only if viewing this kind of material is legal where you are. If that isn’t true for you, you must leave the website now.

You are responsible for making sure that no minor can see the website through your devices or accounts. Parental control tools can help with this.

PornNook is a video sharing website. It lets people upload, share and watch adult videos and related material. The videos on the website are uploaded by its users; we don’t produce them.

The website may link to other websites that we don’t own or control. We aren’t responsible for their content, their privacy practices or anything else about them, and you use them at your own risk.

We may change, suspend or stop any part of the website at any time, with or without notice.

The website is for your personal, non-commercial use. You agree not to:

• use the website for anything illegal, or in a way that could expose us to legal liability;
• copy, download, scrape or redistribute content from the website, except through features the website itself offers;
• collect usernames, email addresses or other information about other users, for example to send them unsolicited messages;
• frame the website, or present its content on another website as if it were your own;
• get around, disable or interfere with the website’s security features or its limits on using or copying content;
• overload, attack or disrupt the website or the servers and networks behind it, or upload viruses or other harmful code;
• use automated tools to create accounts, upload, vote, report or send messages;
• impersonate anyone, or misrepresent who you are or who you act for.

The information you give us when you create an account must be accurate. Keep your password secret: you are responsible for everything done with your account. Tell us straight away through the Support form if you think someone else is using it.

We may suspend or close any account, and remove what it uploaded, at any time if we believe it broke these Terms, the law or the rights of others, or for any other reason at our discretion.

You are solely responsible for everything you upload or post to the website (your “Uploads”) and for the consequences of publishing them. For every Upload, you confirm and guarantee that:

• everyone shown in it was at least 18 years old when it was recorded;
• you keep, or can obtain from the producer, the records of the age and identity of everyone shown in it that 18 U.S.C. §2257 and 28 C.F.R. Part 75 require, and will provide them when lawfully asked;
• everyone shown in it agreed to be recorded and agreed to it being published on this website, and you have their written consent, release or permission to use their name and likeness this way;
• you own it, or you have all the licenses, rights and permissions needed to upload it and to give us the license below, and it doesn’t infringe anyone’s copyright, trademark, privacy, publicity or other rights;
• it doesn’t break any law or these Terms.

We don’t guarantee that anything you upload or send us will be kept confidential.

You keep ownership of your Uploads. By uploading, you give PornNook a worldwide, non-exclusive, royalty-free, sublicensable and transferable license to host, store, copy, format, display, perform and distribute your Uploads, and to make edited versions such as previews, thumbnails and different formats, in connection with running and promoting the website, including on other websites we own or operate. You also give every user of the website a non-exclusive license to watch your Uploads through the website’s features.

These licenses end when your Upload is removed from the website, except for copies we must keep by law, copies kept for a reasonable time in backups, and any use that has already been made.

You agree not to upload, post or send anything that:

• shows, or appears to show, anyone under 18 years old;
• shows anyone who didn’t agree to be recorded or to the content being published, including hidden-camera recordings and intimate images shared without consent;
• shows or promotes rape, sexual assault, torture, snuff, death, bestiality, real violence or physical harm against anyone, or cruelty to animals;
• shows anyone who is asleep, drugged, intoxicated or otherwise unable to consent;
• is obscene under applicable law, or is otherwise illegal where it was made, where you are, or where we are;
• you don’t have the rights to, or that infringes anyone’s copyright, trademark, privacy or publicity rights;
• is defamatory, harassing, threatening or hateful, or reveals anyone’s personal information without their consent;
• contains advertising, spam or solicitations;
• contains viruses or other harmful code.

We have zero tolerance for child sexual abuse material and for any other content involving minors, and for content shared without the consent of the people shown. Such content is removed, the accounts that uploaded it are closed, and we report it to the relevant authorities and cooperate fully with law enforcement.

We may refuse, remove, hide or restrict access to any content on the website, and suspend or close any account, at any time, for any reason or for no reason, with or without notice. We aren’t obliged to monitor the website or what is uploaded to it, and we aren’t responsible for doing so.

Content on the website comes from many different users. We don’t endorse any of it or any opinion expressed in it, and we aren’t responsible for its accuracy, legality, quality or safety. You may come across content you find offensive or objectionable; you use the website at your own risk.

If you see something that breaks these Terms or the law, please report it using the Report link on the video’s page or the content removal form.

We respond to notices of claimed copyright infringement that follow the Digital Millennium Copyright Act. How to send one is explained on our DMCA / Copyright Claims page. We close the accounts of users who repeatedly infringe the rights of others.

Apart from users’ Uploads, everything on the website, including its design, text, graphics, logos and software, is owned by or licensed to PornNook and is protected by copyright, trademark and other laws. You may not copy, sell, license or otherwise use it without our written permission. We keep all rights not expressly given to you in these Terms.

Using the website is currently free. We may charge for some features in the future, and may change those fees at any time. If we close your account because you broke these Terms, you won’t be entitled to a refund of anything you have paid.

The website and everything on it are provided “as is” and “as available”, without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement, to the fullest extent permitted by law. We don’t warrant that the website will be uninterrupted, secure or free of errors, viruses or other harmful components, or that any content on it is accurate, complete, legal or safe. Your use of the website is at your sole risk.

To the fullest extent permitted by law, PornNook and its owners, operators, officers, employees and agents will not be liable for any direct, indirect, incidental, special, consequential or punitive damages arising from or related to your use of, or inability to use, the website or any content on it, including content uploaded by users, the conduct of any user or third party, unauthorized access to our servers or to information stored on them, or any interruption of the website, whether based on warranty, contract, tort or any other legal theory, and even if we were told such damages were possible.

You agree to defend, indemnify and hold harmless PornNook and its owners, operators, officers, employees and agents from and against all claims, damages, losses, liabilities, costs and expenses (including reasonable lawyers’ fees) arising from your use of the website, your Uploads, your breach of these Terms, or your violation of any law or of the rights of any third party. This continues after you stop using the website.

You may not transfer your rights or obligations under these Terms. We may transfer ours without restriction. If any part of these Terms is found invalid or unenforceable, that part is removed and the rest stays in effect. If we don’t enforce a part of these Terms, that doesn’t waive our right to enforce it later. These Terms, together with the pages they link to, are the whole agreement between you and us about the website.
