Copyright infringement notices and counter-notifications

We respect the intellectual property rights of others. You may not infringe the copyright, trademark or other proprietary rights of any party. We may, in our sole discretion, remove any content we have reason to believe violates the intellectual property rights of others, and may terminate your use of the website if you submit any such content.

Repeat-infringer policy. Any user for whose material we receive repeated good-faith and effective complaints will have their account terminated and lose the right to use the website.

Digital Millennium Copyright Act

Pursuant to Title 17, Section 512(c)(2) of the United States Code, if you believe that any of your copyrighted material is being infringed on the website, we have designated an agent to receive notifications of claimed copyright infringement. Notifications should be emailed to our designated agent:

Copyright AgentPornNookEmail: support@pornnook.com

If you are requesting removal of intimate content that shows you and was published without your consent, please use our dedicated content removal form instead. Those requests are handled first, and content is removed within 48 hours of a valid request.

What your notice must include

To be effective, your notification must be in writing and include all of the following (17 U.S.C. §512(c)(3)):

  1. Identification of the copyrighted work that you believe is infringed (or, if several works are covered by one notification, a representative list of them). Please describe the work and, where possible, include a copy or the location (e.g. a URL) of an authorized version of the work.
  2. Identification of the material that you believe is infringing and that you want removed, and its location. Please describe the material and give the URL of each video on the website, or any other information that will allow us to locate it.
  3. Information that will allow us to contact you, including your address, telephone number and, if available, your email address.
  4. A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  5. A statement that the information in the notification is accurate, and, under penalty of perjury, that you are the owner, or are authorized to act on behalf of the owner, of an exclusive right that is allegedly infringed.
  6. A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.

When we receive a notification that meets these requirements, we remove or disable access to the material promptly and let the user who uploaded it know.

Please don’t make false claims

If you request removal of content by submitting an infringement notification, please remember that your actions have legal consequences. Do not make false claims of infringement. Under 17 U.S.C. §512(f), anyone who knowingly materially misrepresents that material is infringing, or that material was removed by mistake or misidentification, may be liable for damages, including costs and attorneys’ fees. Misuse of this procedure may also result in the suspension of your account or other legal repercussions. Before sending a notification, please consider whether the use could be a fair use; if you’re not sure whether material infringes your copyright, you may wish to speak to a lawyer first.

Counter-notification

If material you uploaded was removed because of a copyright notification and you believe it was removed by mistake or misidentification, you may send a counter-notification to our designated agent above. It must be in writing and include all of the following (17 U.S.C. §512(g)(3)):

  1. Your physical or electronic signature.
  2. Identification of the material that was removed, and the location (URL) where it appeared before it was removed.
  3. A statement, under penalty of perjury, that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material.
  4. Your name, address and telephone number, and a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or, if your address is outside the United States, any judicial district in which PornNook may be found), and that you will accept service of process from the person who sent the original notification, or that person’s agent.

When we receive a valid counter-notification, we promptly send a copy to the person who sent the original notification and tell them that we will restore the material in 10 business days. We restore it no less than 10 and no more than 14 business days after receiving the counter-notification, unless our designated agent first receives notice that the person who sent the original notification has filed an action seeking a court order to stop the user from engaging in the infringing activity.
